ESC Update on Meeting with TCPS Concerning HB 1769

On Wednesday, 12/10/03 Rick Fisher and I drove to Austin and met with Dan Hinkle-Burlington Resources Lobbyist, Keith Oakley Lobbyist for Security Guard Association, George B. Craig- Chair, TX Commission on Private Security, Michael Samulin, Commission Member of TX Commission on Private Security as well as the Executive Director of the TX Commission of Private Security. 

The meeting lasted about an hour and one-half in which many of the issues mentioned by the membership were discussed.  Our concerns and objections were noted. 

It was agreed by all present to work out a positive solution to the issues and concerns we discussed.  The following actions are to be undertaken. 

  1. The Executive Director of the TX Commission on Private Security will issue a letter of intent to place a moratorium on the enforcement of Corporate Security Regulation as it applies to HB1769 and Section 3 of 1702-323, Occupation Code paragraph (e).

  1. It will then be presented to the TX Private Security Commission for such authorization.

 

  1. Efforts will then be made in Parallel to draft a letter from Representative Joe Driver stating that Corporate Security Regulation was not the intent of this Bill or its sponsorship. 

 

  1. This letter will be drafted by Hinkle & Oakley, for our view and input. (Due by Mid Feb. 2004)  

 

  1. This in turn will set the stage to make appropriate changes to HB1769 during a special session if possible.

 

 Special thanks go out to Dan Hinkle and Keith Oakley for bringing everyone together and working in concert to resolve some sensitive issues.  Further some sincere thanks goes to the Commissioners of Texas Private Security Commission and its Executive Director  for working to resolve the issues in a professional manner and to stop the results of some unintended consequences involving HB 1769.

 

 We will follow this as it progresses and keep everyone informed.  We have also put contacts in motion to avoid these pitfalls in the future.
